Court issues bench warrant against civil servant

A Gwagwalada Chief Magistrates’ Court, FCT, has issued a bench warrant authorising the arrest of a civil servant, Osaretin Oduh for allegedly causing hurt.

The Chief Magistrate, Malam Munir Sani, issued the warrant, following an oral application made by the Prosecution Counsel, Abdullahi Tanko, who said that the defendant was absent to defend the charge against him.

Sani also ordered that the surety, Mr Ochaja Akor, be arrested for failing to appear before the court even after he was served notice to appear.

He adjourned the matter until April 19 for hearing.

The police charged the civil servant with criminal conspiracy, assault and causing hurt which he pleaded not guilty to.

Tanko told the court that the complainant, Mr Pius Kwado of University of Abuja Teaching Hospital reported the matter at the Gwagwalada Police station on July 26, 2019.

He said that the Oduh and Emmanuel Akor conspired and assaulted the complainant  on his farm on April 16, 2019.

He said they injured the complainant on the left eye.

The prosecutor said that the offence contravened the provisions of Sections 97, 265 and 247 of the Penal Code.

Section 265 states that whoever assaults or uses criminal force to a person otherwise than on grave and sudden provocation given by that person shall be punished.

If grievous hurt is caused to any person by such assault or criminal force with imprisonment which may extend to three years or with fine or both.
