Court orders Cross River State Water board to pay N78.3 to Anngood Global Investment Nigeria Limited

A State High Court in Cross River has ordered the Cross River Water Board Limited to pay N78.3 million debt to Anngood Global Investment Nigeria Limited, in Calabar.

The court gave the order on Friday. The sum owed is for the supply of 100 tonnes of Aluminium Sulphate, 40 tonnes of Hydrate Lime, and 600 drums of Calcium Hydrochloride.

The claimant had supplied the items to the state water board “vide Local Purchase Order (LPO) No. 030 dated April 24, 2020.”

The Suit

In the suit marked, HC/163/2021, the plaintiff approached the court seeking a declaration that the willful neglect and refusal of the defendant to pay N78.3m for the supply of the items was a breach of contract.

While Anngood Global Investment Nigeria Limited is the plaintiff, Defendants in the suit include are; the Water Board and the State Attorney General.

The claimant prayed the court to order the defendant to pay the sum of N20 million as damages caused by the breach of contract.

Judge Ukpai Ibitham held that that Water board had indeed breached the contract with the plaintiff.

He noted that the defendant had paid N10m to the plaintiff’s account in the “course of the undefended proceedings”.

Consequently, he ordered the defendants to pay the balance of N78.3 million.

The judge also awarded a N100,000 cost against Cross River State water board as general damages suffered by the claimant due to the breach of contract.
