Supreme court to deliver Judgment on Tinubu’s case

The Supreme Court will today deliver judgment on the case against the president-elect Bola Ahmed Tinubu, of the All Progressive Congress,.

The case was filed by the presidential candidate of the People Democratic Party, Atiku Abubakar.

The appeal is seeking the disqualification of Tinubu and his vice as the winner of the February general election.

At the Court of Appeal, the suit was dismissed on the ground that the PDP failed to establish that it had locus standi to institute the case.

Background

Recall that the PDP instituted the suit on July 28, 2022, against the APC on the ground that the party violated the provisions of the Electoral Act, 2022 by allowing Shettima’s nomination as Tinubu’s vice.

PDP claimed it was unlawful and violated the provision of the law.

party sought an order disqualifying the APC, Tinubu, and Shettima from contesting the election.

They submitted that Shettima’s nomination as Tinubu’s running mate was in breach of the provisions of the Electoral Act, 2022.

According to the party, Shettima as at that time could not contest as vice presidential candidate and also Borno central senatorial seat, at the same time.

However, the case was dismissed by Justice James Abundaga of the Court of Appeal

It was dismissed on the grounds that the PDP lacked the locus standi to institute the suit.

The PDP subsequently approached the apex court seeking to overturn the decison of the court of appeal.

At the last hearing, they prayed the supreme court to set aside the judgment of the Court of Appeal.

The apex court adjourned the case until today May 26, for judgement.
