Obi, Atiku takes presidential election challenge to supreme court

Peter Obi, the presidential candidate of the Labour Party, has taken decisive action in response to the recent tribunal ruling that upheld the victory of President Bola Tinubu. 

In a significant legal move, Peter Obi, represented by his lead counsel, Dr. Livy Uzoukwu, SAN, is formally contesting the tribunal’s verdict by filing an appeal.

The notice of appeal, which comprises 50 distinct grounds, reflects Peter Obi’s dissatisfaction with the tribunal’s decisions in case no:CA/PEPC/03/2023

This case was consolidated with Election Petition No: CA/PEPC/04/2023 and CA/PEPC/05/2023.

The appeal before the Supreme Court, signifies Obi’s commitment to pursuing legal avenues to address his concerns regarding the tribunal’s ruling. 

In his notice of appeal, Obi is seeking the reliefs outlined in paragraph 4 of the notice.

Similarly, Atiku Abubakar, the presidential candidate of the Peoples Democratic Party (PDP), has made efforts to nullify the election President Tinubu.

On Tuesday, Atiku filed 35 grounds of appeal before the Supreme Court in his pursuit of legal action.

Atiku, represented by a legal team led by Chief Chris Uche, SAN, is seeking to overturn the judgment delivered by the Court of Appeal on September 6. 

This judgment affirmed President Tinubu, a member of the ruling All Progressives Congress (APC), as the valid winner of the presidential election that took place on February 25.

In his submission to the Supreme Court, Atiku contends that the verdict delivered by the Justice Haruna Tsammani-led five-member panel of the Presidential Election Petition Court (PEPC) was not only perverse but also resulted in a grave miscarriage of justice against him.

The former Vice President of Nigeria, maintains that the PEPC panel made a significant legal error by failing to nullify the presidential election due to non-compliance with the Electoral Act of 2022. 

He argues that the evidence presented before the panel clearly demonstrated that the Independent National Electoral Commission (INEC) had acted in violation of existing laws and regulations governing elections.

Furthermore, Atiku accuses the PEPC of reaching a unanimous decision based on a gross misconstruction and misrepresentation of provisions in both the 1999 Constitution, as amended, and the Electoral Act of 2022.
