The Supreme Court is gearing up to deliver its verdict on Thursday, 26th October, 2023.
This is regarding the appeals brought by the presidential candidates of the People’s Democratic Party (PDP), Abubakar Atiku, and Labour Party’s Peter Obi.
Atiku and Obi contest the outcome of the February 25 presidential election, which was upheld by the Presidential Election Petition Court (PEPC), cementing President Bola Tinubu’s victory.
This judgment was met with dissatisfaction by Atiku and Obi, leading them to filing N appeal before the apex court, urging it to reverse the PEPC’s decision.
Atiku has based his appeal on 35 grounds, asserting that the PEPC made legal errors and resulted in a miscarriage of justice.
He argues that the lower court should have annulled the presidential election held on February 25 due to Electoral Act 2022 non-compliance, as evident from grave misrepresentation.
On the other hand, Obi, represented by Mr. Levi Uzoukwu, SAN, has implored the apex court to overturn the PEPC’s dismissal of his petition, urging the court to grant his appeal and the accompanying requests.
However, the respondents, including the INEC, President Tinubu, and the APC are calling for the dismissal of the appeals, asserting their lack of merit and frivolous nature.

Mr. Wole Olanipekun, SAN, Tinubu’s attorney, specifically characterizes Atiku’s appeal in the supreme court as abusive and requests the court to reject it.
The seven-member panel of justices, led by Justice Inyang Okoro, has considered both appeals and has 26th October for judgment.
It’s worth noting that Atiku and Obi’s petitions, although consolidated, were heard separately.
