The Niger State High Court saw before it the initiation of a legal proceeding by the children of the late Engr. A.A. Kure.

The proceeding on Thursday, was against their brother, Umar Abdulkadir Kure.

The lawsuit revolves around the administration of their deceased father’s estate, which became a subject of contention among the heirs.

Background

The lawsuit, brought forth by Ibrahim Abdulkadir and Khadijat Abdulkadir, represents all the heirs of Engr. A.A. Kure, who passed away without a will in February 2017.

Court documents reveal that, in accordance with Islamic law, an official administrator was appointed for the estate’s distribution.

However, the plaintiffs alleged that Umar Kure, the defendant, misappropriated assets totaling N69.2 million, including vehicles and machinery.

The plaintiffs further assert that Umar not only sold off these assets but also forcibly took control of properties valued at N93 million, designated for them and other heirs.

Among these properties are a Toyota Hilux, tractors, a GMC Jeep, and generators. Despite demands, Umar allegedly refuses to return these assets, prompting the legal action.

The plaintiffs seek court declarations affirming the proper distribution of the estate under Islamic law.

They also request orders compelling Umar to account for and return the misappropriated assets.

Additionally, a perpetual injunction is sought to prevent further interference with properties allocated to other heirs.

In an affidavit, the 1st plaintiff, Ibrahim, detailed the alleged actions of Umar, emphasizing the deprivation of their rightful inheritance.

The court is yet to schedule a date for the hearing of the case.
