Appeal Court Upholds Governor Fintiri’s Victory

The Court of Appeal has upheld the victory of Governor Fintiri of Adamawa State.

The appellate court on Monday dismissed Aisha Binani’s petitions against the judgment of the State governorship election petition tribunal.

A three-member panel of justices, led by Justice T. O. Awotoye, delivered a unanimous decision affirming Fintri’s re-election.

Background

The legal battle stems from the Adamawa State governorship election, where Binani, the defeated APC Guber Candidate, contested the results.

The Election Petition Tribunal had previously upheld Fintiri’s win which led to Binani filling an appeal.

Her appeal sought to invalidate the tribunal’s judgment that dismissed her petition in its entirety.

Court’s Decision

The appellate court, in its ruling, affirmed the decison of the tribunal. emphasizing that it was correct in dismissing Binani’s petition.

The court held that the grounds for the appeal were unfounded and lacked merit, thereby confirming Governor Fintiri’s legitimate re-election.

In a noteworthy move, the court ordered Aisha Binani to pay a sum of five hundred thousand Naira to each of the respondents.Governor Fintiri, INEC, and PDP totaling 1.5 million Naira.

This financial penalty was imposed due to the filing of a vague application, emphasizing the court’s stance on the importance of clarity and substance in legal proceedings.
