Court denies bail to suspects in Rivers house of assembly attack

The Federal High Court has denied bail to Governor Fubara’s loyalists, who are facing terrorism charges.

The court on Monday rejected their bail applications, filed and argued by Fagbemi ( SAN), deeming them lacking in merit.

Justice Mobolaji Olajuwon, in her ruling, stated that the defendants failed to provide special circumstances justifying their release from Kuje Prison.

The Judge criticized the insufficient evidence supporting bail requests, particularly citing vague and hearsay claims in the affidavits, which lacked relevant facts and did not comply with the Evidence Act.

The court dismissed the assertions that the defendants would not jump bail, commit further offenses, or interfere with witnesses and investigations.

Justice Olajuwon highlighted the seriousness of the charges, stating that terrorism offenses are not ordinarily bailable.

The Judge also refuted claims related to health issues, noting the absence of medical documents and disputing the IGP’s argument that the sickness could be managed within the prison.

As a result, the court ordered the defendants to remain in Kuje Prison, scheduling an accelerated trial for February 8, following terrorism charges related to the alleged invasion and burning of Rivers State House of Assembly in October 2023.

The charges involve the death of a Superintendent of Police and police informants and the use of various cult groups to instigate violence in the state.
